Welcome to TerribleCat Music ("we," "our," or "us"). We're an original music streaming app and independent label built by and for musicians. These Terms of Service ("Terms") govern your use of the TerribleCat app, website, and any related services. By using our platform, you agree to follow these rules.

If you don't agree, don't use the app.

1. Who Can Use TerribleCat Music

You must be at least 13 years old to use the app. If you're under 18, you need permission from a parent or guardian.

If you're an artist submitting music, you must own or control all rights to the music and content you provide. No stolen tracks, no unlicensed samples, no AI-generated junk — this is a human-made music platform.

2. Accounts

Some features require you to create an account. Keep your login details private — you're responsible for what happens under your account.

If you think someone else is using your account, contact us through the Support section in the app.

3. Using the App

You're allowed to:

Listen to music for personal, non-commercial use
Create playlists and use the app as intended
Submit your own music if you're a participating artist

You're not allowed to:

Rip, download, or reproduce music outside the app's intended features
Share your login with others
Upload content you don't own
Use bots, scrapers, or other unauthorized tools
Abuse, spam, or harass others
Use the app to promote hate, violence, or illegal activity

4. Artist Submissions & Payments

You keep full ownership of your music.
You grant us a non-exclusive license to stream and promote your music inside the app.
If your album is selected and eligible, we may offer direct payment or a share of subscription revenue. Details vary by release and will be discussed case-by-case.
We reserve the right to remove content at any time (though we'll try to be cool about it).

5. Content Ownership

You own your music.

We own the design, layout, branding, code, and functionality of TerribleCat.

You agree not to copy, clone, or repurpose the app or its design for your own platform, service, or tool.

6. Subscription & Billing

If you sign up for a paid tier:

You agree to recurring charges until you cancel.
Prices may change — we'll notify you first.
Cancellations take effect at the end of your billing cycle.
No refunds unless required by law.

Free users may hear occasional messages or promotional content. We don't use invasive ads and never sell your personal data.

7. Analytics & Data

Analytics collection is optional and under your control.
By default, analytics are disabled.
You can enable or disable analytics anytime in Settings.
When enabled, we collect usage data to improve the app and pay artists fairly.
Analytics are sent securely to AWS CloudWatch.
We never sell your data or share it with advertisers.

8. Termination

You can delete your account anytime through the app.

We may suspend or terminate your account if you break these Terms or misuse the platform.

9. No Warranties

We're doing our best, but:

The app is provided "as is," with no guarantees it'll always work perfectly.
We aren't responsible for data loss, bugs, or service interruptions.
We aren't liable for what happens if you misuse the app.

Use it responsibly.

10. Intellectual Property

All rights, title, and interest in the TerribleCat app, website, design, branding, trademarks, and underlying technology belong to TerribleCat.

You may not copy, modify, reverse-engineer, distribute, scrape, or otherwise exploit the app or its contents without our written permission.

11. Limitation of Liability

To the fullest extent allowed by law, our total liability for any claims related to the app is limited to the amount you paid us in the 12 months before the claim arose.

12. Indemnification

If you do something that causes legal trouble (like uploading stolen music or breaking these Terms), you agree to cover any claims, damages, or expenses (including legal fees) that come our way because of it.

13. Dispute Resolution & Legal Costs

If we ever have a serious dispute, we'll try to work it out informally first.

If that doesn't work, the dispute will be handled through binding arbitration in New York under the rules of the American Arbitration Association.

If you bring a claim against us and lose, you agree to pay our reasonable legal fees and costs. If we bring a claim against you and lose, each side covers their own costs.

14. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of New York, USA. Any disputes must be resolved in New York County, New York.

15. Changes to These Terms

We may update these Terms occasionally. If we do, we'll notify you in the app. Continued use after changes means you accept the new terms.
